I’ve been reading about the principle of freedom of contract and how it functions in contemporary legal systems. Parties are free to agree on terms on paper and there is no interference but in practice there seem to be many limits imposed by courts and legislation. But how far should this freedom go in the law of today? And when does public policy, consumer protection or unequal bargaining power justify restrictions? I am also interested in ideas and perspectives on contract law research paper topics that relate to this area, especially those that examine the balance between autonomy and regulation.
